Terms and conditions


THE RENTER ACKNOWLEDGES that Ocean Properties Vacation Rentals, Inc. welcomes families, married couples, and single adults. The primary renter must be at least 25 years of age.

The person in whose name the property is reserved will be held responsible for ensuring all occupants comply with the rental policies, procedures, and restrictions. Any damages to the property or its contents, beyond normal wear and tear, will be the responsibility of the reserving party. The reserving party must be at least 25 years of age, represent a responsible family group, and occupy the property for the entire rental period. High school or college groups, regardless of age, are strictly prohibited. Any group causing a disturbance or disrupting the peaceful enjoyment of neighboring properties will be subject to immediate eviction without a refund.

Only listed occupants are permitted on the property. If additional guests are expected, Ocean Properties Vacation Rentals, Inc. must approve beforehand. If unauthorized occupants are discovered, the responsible party will be asked to vacate immediately. No fraternities, school, or civic groups are allowed, and parties are strictly prohibited.

NO SUBLEASE OR ASSIGNMENT.  Renter shall not subject or assign the Agreement without the prior written consent of Agent.          

All guests must comply with Florida law regarding alcohol: the legal drinking age is 21, and minors in possession of alcohol face fines, community service, and a record of any offense. Local authorities have the right to investigate suspicions of alcohol possession by minors on the property. Violations of these terms will result in immediate eviction without refund. By signing or making payment, you accept all terms and conditions as outlined.
 
COMPLIANCE WITH RULES AND REGULATIONS.   Renter shall take all reasonable steps to see that he/she, members of his/her family, and other occupants of the Premises adhere to the rules and regulations applicable to the Premises.  Failure to do so may lead to the forfeiture of the Security Deposit (where applicable) or Renter may be asked to leave with NO REFUND.  The following rules and regulations being cited below are exceptionally important:

  • The occupancy of the Premises and the use of community walkways and common area shall be sufficiently quiet and peaceful so not to disturb others.  ABSOLUTELY NO NOISE AFTER 10:00PM.
  • Use of the amenities and facilities of the Premises is limited to Renter and registered guests.  Parents are responsible for the behavior of their children.
  • If you are renting a condominium, your unit is confirmed with the understanding that you will adhere to the rules and regulations set by individual Condominium or Homeowner Association.

In accepting this rental, you agree to be responsible for any damage caused by your party or guests.  If renting a condominium, you also agree to register all overnight guests and agree to abide by the condominium rules and regulations.      

DAMAGES: Renter shall be responsible for any damage done to the property or equipment located on the premises, by Renter, Renter's Gusts, or any other person(s) affiliated with Renter. Renter understands and agrees that Agent will hold the Renter financially responsible for the repair and/or replacement of any property and/or equipment should it be damaged during the Renter's stay and authorized use of the property.  All of Renter's property kept, parked, or stored on the Property during Renter's use of the Property shall be so kept, parked or stored at the risk of Renter. Agent shall not be responsible for any loss or damage to Renter's property and Renter shall hold Agent harmless from any claims arising out of loss or damage to any such property.  Ocean Properties Vacation Rentals, Inc. reserves the right to charge your credit card on file for damages.

MAINTENANCE.  Any maintenance items should be reported to Ocean Properties Vacation Rentals, Inc. during the course of normal business hours.  DO NOT CALL INDIVIDUAL CONDOMINIUM MANAGER’S OFFICE.  In the event of an emergency after hours, call (386) 428-0513.  In case of appliance, A/C, or plumbing failure, same day repair cannot be guaranteed, but every effort will be made to provide service as quickly as possible.  Renter shall not be entitled to any refund, reduction, or substitution based on maintenance issues.

ENTRY OF PREMISES.  Agent or an authorized employee or repairman may enter the Premises during customary hours for any purpose connected with the repair, improvement, care and management of the Premises.  In case of emergency, access must be granted regardless of hour and without notification.

CONSTRUCTION NOTICE: From time to time, construction, repair, or renovation projects may be underway at or near the rental property, including within the building or complex. If such activities are disclosed to Renter in advance of check-in, Renter acknowledges and agrees that the presence of construction, including associated noise, dust, limited access, or utility disruptions, shall not serve as a basis for cancellation, substitution of accommodations, reduction in rental rate, or refund of any kind. Ocean Properties Vacation Rentals, Inc. shall not be held responsible for construction activities scheduled or performed by other units, associations, contractors, or neighboring properties.

EQUIPMENT FAILURE AND OTHER UNFORESEEABLE INCONVENIENCES – All equipment within the property is intended to be in good working order upon your arrival. Should any equipment issues arise, please report them to our office promptly. We will make every reasonable effort to resolve reported issues; however, no refunds or rent reductions will be provided due to mechanical or equipment failure. Please be aware that, while we strive to address inconveniences as swiftly as possible, certain matters may rely on third-party utility providers, maintenance vendors, or external scheduling beyond our immediate control.

Examples of potential inconveniences include, but are not limited to: malfunctions in electronics, appliances, or property elevators; utility disruptions; hot tubs, private/community pools; construction noise or activity nearby; weather-related impacts, including road closures and hazardous conditions; and the presence of insects or pests (e.g., spiders, flies, ladybugs, palmetto bugs, or no-see-ums).

Refunds will not be granted for equipment-related issues, but we commit to making every reasonable effort to address your concerns in a timely and effective manner.

SUBSTITUTION OF COMPARABLE ACCOMMODATIONS.  Rates and availability of accommodations are subject to change without notice.  Agents have authority from Owner to commit for certain period during the twelve months following the confirmation date of this rental.  Should Owner list the Premises for sale prior to the dates of the Renter’s occupancy or should Owner occupy the Premises as a resident or otherwise prohibit Agent from renting the Premises notwithstanding Owner’s agreement with Agent, the Agent may provide Renter with substitute accommodations for the dates of Renter’s occupancy, which Renter agrees to rent under the Agreement, provided the substitute comparable accommodations do not have a higher rental than the Premises.  If a similar property is not available, guest will receive a full refund.   Similarly, should the Premises be undergoing major repairs, redecoration, etc. Agent may provide Renter with substitute comparable accommodations.  If a similar property is not available, guest will receive a full refund.     

HOUSEKEEPING: The housekeeping fee covers no more than 1 load per bedroom plus an additional load.  For example: 2-loads of laundry for a 1 bedroom, 3-loads for a 2 bedroom, 4-loads for a 3 bedroom, etc.  Any additional laundry will result in an additional charge of $25/load.  Ocean Properties Vacation Rentals, Inc. reserves the right to charge your credit card on file.

Housekeepers do not wash dishes.  All dishes must be cleaned before departure, they may be left in the dishwasher.  Please remove all trash prior to your departure. Failure to leave Premises in a neat, orderly condition will result in additional charge.  Ocean Properties Vacation Rentals, Inc. reserves the right to charge your credit card on file. Daily housekeeping service is available for an additional fee. 

FURNISHINGS.  Renter understands that the Premises and its furnishings are privately owned.  Neither the Agent nor the Owner shall be responsible for providing any additional furnishings or equipment not specified in the literature.  The Premises is complete with a fully equipped kitchen, linens, and a courtesy starter kit of basic paper/soap products.  Beach towels and beach chairs may not be provided.  Property owners want you to enjoy their Florida home as they do.  Please treat their possessions as you would your own.         

BAR-B-QUE GRILLS: Agent offers a variety of homes and condos, some with barbecue grills for guest use. Grills are not maintained or cleaned by our team, and guests assume all liability when using them. If used, the grill must be cleaned thoroughly, with all food debris and grease removed. A $100 fee will apply if the grill is left dirty or requires extra cleaning. Basic cleaning supplies are provided. By using the grill, guests accept full responsibility for safe use and proper care.      

NON-SMOKING.  All properties are NON-SMOKING.  This includes smoking on the balconies.  Upon check out, we will inspect the property.  If smoking in the property has occurred during your stay, you will be charged a $300 fee.  Ocean Properties Vacation Rentals, Inc. reserves the right to charge your credit card on file.     

MILDEW/MOLD.  Please report any mildew or mold that you might notice immediately after check-in and before departure.  

PARKING RESTRICTIONS (where applicable).  All parking is at your own risk and is generally available on a first-come, first-serve basis; therefore, it cannot be guaranteed. Some condominium complexes require parking passes for both owners and guests. If a parking pass is required and the onsite office is closed upon your arrival, you must obtain a pass as soon as the office reopens. Failure to follow posted parking restrictions may result in your vehicle being towed at your sole expense. Parking areas at some locations may only accommodate standard automobiles; motor homes, travel trailers, boat trailers, pickup trucks, and similar vehicles may not be permitted in certain complexes.

TENNIS (where applicable).  Allocation of court times and administration of court rules are controlled by management on the site.  Not all sites have tennis courts.

POOL POLICIES (where applicable).  Use of the pool and spa is limited to Renter and registered guests only.  

POOL HEAT: Pools may not heat to Guest’s desired temperature during colder weather and may take up to 48 hours to reach maximum temperature. There are no refunds for dissatisfaction with pool heat. Should the pool or spa be unusable for any reason, Agent assumes no responsibility and such occurrence shall not constitute sufficient cause for a refund. Condominium Pools: We cannot guarantee that the pool will be heated at your condominium, however, we will make every effort to apprise you of your condominium’s particular guidelines concerning heating the pool and relevant pool regulations. Pool Safety.  Use of swimming pools and hot tubs is “at your own risk”.  Running & diving are prohibited. Children, of any age, are not allowed in the pool area without adult supervision. When available, safety netting & pool alarms must be used at all times and doors must be kept closed & locked. If the property has a Drowning Detection Alarm, all alarms must be turned back on when the pool is not in use by guests. All guests assume the risks of use and waive the right to file suit against the owner and/or Ocean Properties Vacation Rentals, Inc. for any loss, damage, injury, or liability that should occur. Any safety concerns, including but not limited to pool alarms, equipment, safety netting, or locks, that are not working properly must be reported immediately to Mgt. Co. 

NO PETS POLICY:  Unless otherwise expressly authorized in writing by Mgt. Co., pets are not permitted at most Rental Properties. Unauthorized animals may result in immediate termination of the rental, forfeiture of all payments, and additional charges for cleaning and damages.  An additional fee of $500 may apply if any evidence of a pet is found in the unit or on the premises.
Pets are only allowed in designated pet-friendly properties with prior written approval from Ocean Properties Vacation Rentals, Inc. Policies vary by property, and condominium associations may impose restrictions on breed, weight, and number of pets. All pets must be disclosed in writing in advance, and approval is at our sole discretion. A non-refundable fee of $175 plus tax per pet applies and must be paid prior to arrival.

SERVICE ANIMALS AND EMOTIONAL SUPPORT ANIMALS
Guest acknowledges and agrees to the following terms regarding animals at the Rental Property:

SERVICE ANIMALS: In accordance with the Americans with Disabilities Act (ADA) and Florida law, Company permits individuals with disabilities to be accompanied by a service animal. A service animal is defined as a dog (or, in some cases, a miniature horse) that is individually trained to do work or perform tasks directly related to the individual’s disability. Please note that emotional support animals, comfort animals, and therapy animals are not considered service animals under the ADA and are subject to our standard pet policy.

  • Company may ask Guest two permissible questions: (a) whether the animal is required because of a disability, and (b) what work or task the animal has been trained to perform.
  • Service animals must remain under the control of their handler at all times. The animal must be housebroken and may not pose a direct threat to the health or safety of others.
  • Guest remains responsible for all damage caused by the service animal and for any extraordinary cleaning required due to the animal’s presence.

FEES AND DAMAGES: While no additional fee will be charged solely for the presence of a service animal, Guest will be responsible for the full cost of any damage caused by the animal, including extraordinary cleaning, pest control, or repair of furnishings or property.

FALSE CLAIMS PROHIBITED: Guest affirms and understands that misrepresenting an animal as a service animal is a violation of Florida law. Pursuant to Florida Statutes §§ 413.08(9), any individual who knowingly and willfully misrepresents themselves as having a disability-related need for a service animal may be subject to penalties including fines and/or criminal charges.

SURVEILLANCE CAMERAS: Guest acknowledges and agrees that some properties may be equipped with surveillance cameras positioned at entry points and along the exterior of the property. These cameras are in place solely for security purposes and do not monitor the interior of the home or any areas where guests have a reasonable expectation of privacy.

OWNER’S CLOSET.  One closet in the Premises may be reserved for storage of the Owner’s personal property and is not included with this rental.

LOST OR STOLEN ARTICLES.  Agent and Owner are not responsible for Renter’s articles lost, stolen, or left behind on or in the Premises.  

MISPLACED ITEMS RETURN FEE:  Guests will be charged a $25 return fee, plus all shipping costs, to return any personal items, misplaced or left behind, in their unit after departure. Ocean Properties Vacation Rentals, Inc. reserves the right to charge your credit card on file for this return fee.

LOST KEYS, GARAGE/GATE REMOTE, PARKING & POOL PASSES.  There will be a $10.00 charge for lost keys or pool passes, $50 for parking passes and up to $200 for lost garage and gate remotes.  Renters staying at the Minorca or Seacrest will be charged a $75.00 fee for lost Fobs (security access key).  Renters at Bouchelle Island are charged up to $150 for lost amenities keys.   

LOCK OUTS.  There will be a $25.00 charge if you are locked out of your room.          

TURTLE SEASON.  Effective May 1 through October 31 each year there are special lighting restrictions in place for the safety of hatching turtles. From sunset to sunrise no light source or reflective surface can be visible to a person standing on the beach. Full details will be included in your check-in document or can be found at www.volusiaseaturtles.org.
Failure to comply with these restrictions can result in up to a $500 fine per occurrence. You will be responsible for payment to the appropriate local government authority issuing the citation. 

AGENCY DISCLOSURE.  Management Company acts as an agent and is paid a fee by the owner of the property.                      

TERMINATION OF RENTAL.  If Renter violates any of the conditions or restrictions on this Agreement, Agent may terminate this Agreement and enter the Premises.  Upon notice of the termination of this Agreement, Renter shall vacate the Premises immediately.  

DISCLAIMER:  The Renter shall not do or permit any act or thing to be done upon the rental premises which may subject Owner to any liability or responsibility for injury, damages to persons or property or to any liability by reason of any violation of any laws, rules, ordinances, regulations, statutes, requirements, restrictions and codes affecting the rental premises or any portion thereof or affecting the maintenance, use or occupation  of the rental premises  or  any portion thereof. The Renter shall exercise such control over the rental premises as to fully protect Landlord and Indemnities against any such liability. The Renter  shall indemnify and save the Indemnities harmless from and against  (i) all claims of  whatever  nature  against  the  Indemnities arising from any act, omission or negligence of the Renter, its contractors, licensees, agents, servants, employees, invitees or visitors; (ii) all claims against the Indemnities arising from any accident, injury or damage  whatsoever  caused to  any person or to the property of any person and occurring during the term in or about the rental premises; (iii) all claims  against the Indemnities arising from any accident, injury or damage  occurring outside  of  the  rental premises but  anywhere  within  or about the real property of which the rental premises is a part, where such accident, injury or damage results or  is claimed to have resulted from an act, omission or negligence of the  Renter or  Renter's contractors, licensees, agents, servants, employees, invitees or visitors; and (iv) any breach, violation or non-performance of any covenant, condition or  agreement  in this lease agreement set forth and contained on the part of the Renter to be fulfilled, kept, observed and performed.  This indemnity and hold harmless agreement shall include indemnity  from and against any and all liability, fines, suits, demands, costs and expenses of any kind or nature  (including,  without  limitation, reasonable  attorneys'  fees and disbursements) incurred in or in connection with any such claim  or  proceeding brought  thereon, and the defense thereof but  except with respect to claims with respect to bodily injury or death, shall be limited to the extent any insurance proceeds collectible by Landlord under policies owned by Landlord or such injured party with respect  to  such  damage  or  injury  are  insufficient  to satisfy same.  "Indemnities" means Owner, Ocean Properties Vacation Rentals, Inc., their respective owners or shareholders, and their respective successors, assigns, employees, agents and contractors. The renter acknowledges that Ocean Properties Vacation Rentals, Inc. acting solely in the capacity of Agent for the property Owner, assumes no liability thereunder.       

COVID-19 DISCLAIMER: An inherent risk of exposure to COVID-19 exists in any public lodging establishment where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death.  According to the Centers for Disease Control and Prevention, senior citizens and guests with underlying medical conditions are especially vulnerable.  Ocean Properties Vacation Rentals, Inc. has taken measures to ensure that properties are properly cleaned and disinfected in accordance with the CDC Clean and Disinfect guidelines.  Renter voluntarily assumes all risks related to exposure of COVID-19.
